论构建全球商事治理基础的可能性

——以贸法会仲裁规则为视角

摘要:全球治理离不开基础治理规范,[1]而基础治理规范则应当构建在两个基础原则之上,一是治理规范必须建立在程序正义(意识形态无涉)之上,二是治理规范效用必须可量化。建立在这两个基础原则上的全球治理规范,具有若干优势:1、价值无涉,即不干预全球不同治理主体的意识形态,确保治理规范的工具性;2、效用可量化性则确保了衡量治理规范的唯一价值尺度,即可以仅从经济效用角度确认规范合理性的区间,而非追求精致的唯一正确的解。基于以上认识,我们认为,UNCITRAL仲裁规则,即联合国国际贸易法委员会(下为贸法会)仲裁规则与各仲裁机构的接口,为初步建立全球商事治理基础规范提供了一种可能。本文试图通过现行贸法会仲裁规则与国际主要仲裁机构接口现状的描述,展示这一模型运作的可能性。并试图通过若干典型案例进一步展示,全球商事治理基础规范的若干基本条件及其运行的边界,进而为全球治理理论提供最优的实践路径。

On the Possibility of Building theFoundations of Global Commercial Governance

From the Perspective of InternationalCommercial Arbitration

Global governance is underpinned by certainbasic governance norms, which are to be constructed through two principles. Theone is procedural justice( ideology-free) and the other is quantification ofthe governance norms' performance. Global governance norms on the basis of theabove two principles bring about such advantages as: firstly, they arevalue-free, which means avoiding intervening with different governancesubjects. Secondly, the quatification of performance serves as the uniquemeasure of the global governance norms and provides a reasonable sphere inrespect of economic utility, instead of seeking a single right answer. We,therefore, hold that the UNCITRAL arbitration rules, with its  connection with several important arbitrationinstitutions, presents the possibility of establishing global commercialgovernance. This paper describes the actual situations of the connection andexplores the possibility. The paper is engaged in discovering the requirementsand limitations of the global commercial governance norms by means of analyzingsome typical cases  and would set forth apossible optimal approach for the global governance theories.
